1. Introduction

Welcome to ViaConecta. These Terms of Service ("Terms") govern your use of our website, mobile application, and eSIM services. By purchasing or using our services, you agree to be bound by these Terms.

2. Service Description

ViaConecta provides prepaid eSIM (embedded SIM) data plans for global connectivity, and operates a flight search aggregator to compare airline prices. We act as a reseller for various eSIM network operators worldwide and as an affiliate aggregator for flight searches.

• The service is for data only (no voice/SMS unless specified).
• Service availability depends on local network coverage.
• You must have an eSIM-compatible and unlocked device.

3. Payments & Billing

Payment Methods: All payments are processed securely via PCI-DSS compliant gateways (Stripe and PayPal) or via your ViaConecta Digital Wallet. We do not store or process raw credit card numbers.

Digital Goods Waiver of Withdrawal (EU Directive 2011/83/EU, Art. 16(m)): In accordance with European Union consumer regulations, by purchasing an instant digital product (eSIM profile QR code, instant data top-up, or virtual OTP number), you expressly consent to the immediate performance of the contract and acknowledge that you lose your statutory 14-day right of withdrawal once the digital activation code has been generated and delivered.

4. ViaConecta Digital Wallet & Prepaid Balance

Prepaid Nature & Closed-Loop Credit: Funds deposited into your ViaConecta Wallet represent prepaid digital store credit denominated in Euros (EUR). The wallet operates strictly as a closed-loop stored-value account intended solely for purchasing ViaConecta products and services (including eSIM profiles, data refills, virtual numbers, and voice line rentals).

• Non-Transferable (AML Compliance): Wallet funds cannot be transferred between user accounts, redeemed for physical cash, or withdrawn to external third-party bank accounts, ensuring strict adherence to European Union Anti-Money Laundering (AML) directives.
• Top-Up Limits: Standard wallet deposits are allowed in increments between €5.00 and €500.00 per transaction.
• No Expiration: Prepaid wallet balances do not expire and remain available as long as your account remains in good standing.
• Automated Credits & Refunds: Any store credits, promotions, or automatic service refunds (such as undelivered OTP sessions) are credited directly to your Wallet balance in real time without processing fees.
• Base Currency & Forex Risk Disclaimer: All internal wallet balances, store credits, and transaction settlements are maintained in Euros (EUR €). Deposits made using foreign currencies (USD, GBP, PLN, BRL, etc.) or cryptocurrency are converted at the prevailing market exchange rate applied by your bank or payment processor. ViaConecta is not a currency exchange provider and assumes no liability for exchange rate variations, conversion fees, or cross-border currency differences (Forex Risk).

5. Virtual Numbers & Telephony Services

• Fair Telephony Use: Telephony lines must NOT be used for automated robo-calling, mass SMS spamming, telemarketing, fraudulent caller ID spoofing, or harassment.
• Session Lifespans: Single OTP numbers are allocated for a strict 10-minute activation window. If no SMS is delivered within this period, the charge is auto-refunded or not billed. Dedicated Web Inboxes and Voice eSIMs operate on 30-day renewable cycles.

6. User Obligations & Sanctions Compliance

You agree strictly NOT to use the service for:

• Illegal activities, fraud, or unlawful content distribution.
• Sending spam, phishing, or unsolicited bulk messages.
• Network abuse, unauthorized port scanning, or denial-of-service attempts.

By using this Service, you represent and warrant that you are not located in, under the control of, or a national or resident of any country subject to trade or economic sanctions by the European Union, Spain, Switzerland, or the United States.

Violation of these rules may result in immediate suspension without refund.

7. Loyalty Program & ViaPoints

ViaPoints (VP): Points are awarded based on EUR spend (defined as 10 VP per 1 EUR). ViaPoints have no cash value and cannot be exchanged for currency. They serve as a status indicator within the platform.

Tiers (Digital Passport): User levels (Tourist, Explorer, Citizen) are calculated based on unique countries visited. ViaConecta reserves the right to modify tier requirements, benefits, or reset program stats at any time with or without notice.

Disqualification: Accounts flagged for fraud, abuse, or chargebacks will forfeit all accumulated Points and Status immediately.

8. Limitation of Liability

ViaConecta provides services "as is". We are not liable for:

• Service interruptions due to carrier maintenance or weak signal.
• Incompatibility of your device.
• Indirect or consequential damages.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain and the European Union.

10. Intellectual Property & Trademarks

Trademarks: "ViaConecta" and the ViaConecta logo are trademarks of ViaConecta.

Third-Party Attribution: Apple, the Apple logo, iPhone, and iPad are trademarks of Apple Inc., registered in the U.S. and other countries. App Store is a service mark of Apple Inc. Google Play and the Google Play logo are trademarks of Google LLC.

Nord Security: "NordVPN" and "NordPass" are registered trademarks of Nord Security.

All other trademarks, including social media logos (Facebook, Instagram, X, LinkedIn), are the property of their respective owners. ViaConecta is not affiliated with, endorsed by, or sponsored by these companies.

11. Affiliate Disclosure

Some links on this website (such as those promoting Nord Security products) are affiliate links. This means we may earn a commission if you click on the link or make a purchase, at no additional cost to you.

We only recommend products or services that align with our mission to improve your travel and connectivity experience. Our affiliate relationships do not influence the price you pay or the terms of service provided by the third party.

12. Flight Search Aggregator & Affiliate Disclaimer

Some features on this site, such as the Flight Search tool, operate as an affiliate aggregator. We do not sell flight tickets directly, process flight-related payments, or handle airline bookings. Any bookings or transactions made using our flight search tool are handled entirely by third-party airlines, booking agencies, or affiliate networks (such as Kiwi.com or Travelpayouts).

When you click to book a flight, you are redirected to a third-party website. Any transactions you make are subject to the terms, conditions, and privacy policies of those third-party providers. ViaConecta is not responsible or liable for any bookings, cancellations, delays, refunds, or disputes arising from these third-party flight services.
