1. Prohibited & Restricted Activities

Prohibited Use:
Peer-to-Peer (P2P) file sharing, or any similar
protocols is
strictly forbidden. Our systems automatically detect this traffic.
Consequence: Detection of torrent traffic will result in the immediate suspension of your eSIM service without a refund. - Illegal Content: Transmitting, distributing, or storing any material that violates applicable laws (including copyright infringement, malware distribution, or illegal content).
- Sending unsolicited bulk messages (SPAM), engaging in network scanning, or attempting to hack/bypass network security.
2. "Unlimited Data" Plans Policy
Our "Unlimited Data" packages are designed to give you peace of mind while traveling, ensuring you never run out of data for essential tasks. However, "Unlimited" refers to the volume of data, not the network capacity.
To prevent abuse, the following rules apply to Unlimited Plans:
Personal Use Only
Unlimited plans are intended for use by a single person on a single smartphone. They are not intended for use in modems, routers, CPE devices, or for stationary home internet replacement.
Hotspot & Tethering
Sharing your internet connection (Hotspot) with other devices is permitted but monitored. Excessive hotspot usage that resembles router behavior (e.g., connecting multiple heavy-bandwidth devices simultaneously) may result in speed restrictions.
3. High-Speed Limits & Network Management
While you have unlimited access to data, carrier partners may prioritize network traffic. If your daily usage exceeds reasonable daily usage thresholds determined by the carrier, your connection speed may be temporarily reduced to ensure network stability for other users. Speed is automatically restored the next day.
ViaConecta partners with top-tier local operators (Tier-1 networks) to provide premium quality. To protect the integrity of the network for all customers, we reserve the right to:
- ๐ Monitor Traffic Types: To detect prohibited activities like P2P/Torrents.
- ๐ Apply Throttling: Temporarily reduce connection speeds for users with abnormal, excessive, or non-human data consumption patterns that degrade the service for others.
- ๐ซ Suspend Service: Terminate the connection if a violation of this FUP is detected, particularly regarding illegal activities or network abuse.
4. Device Compatibility
You are responsible for ensuring your device is eSIM compatible and network unlocked before purchasing a plan. ViaConecta cannot be held responsible for service failure if the device is incompatible or locked by another carrier.
5. Limitation of Liability & Disclaimer
ViaConecta acts as a reseller of connectivity services provided by global network operators. By using our service, you acknowledge the following:
Service Availability ("As Is")
The service is provided on an "as is" and "as available" basis. ViaConecta does not guarantee that the service will be:
- Uninterrupted, timely, or error-free (mobile networks depend on local coverage, weather, and maintenance).
- Available in every specific location within a country (remote areas may have no signal).
- We are not responsible for the quality of the local carrier network (e.g., Vodafone, Orange, AT&T) in the destination country.
Exclusion of Liability
To the maximum extent permitted by applicable law, ViaConecta shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to:
- Loss of profits, business interruption, or loss of data.
- Costs of substitute goods or services (e.g., if you have to buy a different SIM card).
- Any failure of the service caused by your device settings, incompatibility, or lack of unlocked status.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid for the specific eSIM package.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.
